Terms & Conditions

These Terms and Conditions apply to all clients booking or attending sessions, purchasing class packs, or holding memberships at MWH Elite Performance Centre ("the Gym"). By booking a session or purchasing a membership, you agree to be bound by these Terms and Conditions.
1. Booking Policy

All group sessions must be booked in advance via the Gym’s official online booking system, app, or at reception.

A session space is only confirmed once the booking is completed and payment (if applicable) has been successfully processed.

Class spaces are limited and allocated on a first-come, first-served basis.
-
Membership holders are still required to book classes in advance and are subject to class capacity limits.
2. Payment Terms
-
Full payment is required at the time of booking unless the client holds a valid class pack or active membership.

Membership fees are charged monthly in advance via automatic recurring payment.
-
All fees are non-transferable and non-refundable, except where required by law or as outlined in these Terms.
3. Membership Terms
3.1 Membership Type
-
All memberships are class-based memberships only.
-
Memberships do not include open gym access or independent training unless explicitly stated.
3.2 Automatic Payments
-
By purchasing a membership, the client authorises the Gym to collect recurring monthly payments using the selected payment method.
-
It is the client’s responsibility to ensure payment details remain valid and up to date.
3.3 Minimum Commitment Period
-
All memberships are subject to a minimum commitment period of two (2) months from the membership start date.
-
Memberships cannot be cancelled during this minimum term, except in exceptional circumstances at the Gym’s discretion (for example, long-term medical incapacity supported by documentation).
3.4 Cancellation After Minimum Term
-
After the minimum commitment period, memberships may be cancelled by providing a minimum of 30 days’ written notice.

Cancellation requests must be submitted via email or through the official booking platform.
-
Memberships remain active and chargeable during the 30-day notice period.
-
No partial refunds will be provided for unused time or sessions.
3.5 Failed or Missed Payments

If a payment fails, the Gym reserves the right to:

Temporarily suspend class bookings;
-
Reattempt payment collection; or
-
Cancel the membership if payment remains outstanding.

Repeated failed payments may result in termination of membership access.
3.6 Membership Use
-
Memberships are strictly personal, non-transferable, and may only be used by the named individual.

Misuse of membership privileges may result in suspension or cancellation without refund.
4. Class Packs & Pay-As-You-Go Sessions

Class packs and single-session passes are valid only for the specified number of sessions.
-
Class packs are non-transferable and non-refundable.
-
Unused sessions are forfeited if the validity period (if applicable) expires.
5. Cancellation & No-Show Policy
-
Sessions must be cancelled or rescheduled at least 12 hours before the scheduled start time.
-
Cancellations made within 12 hours of the session start time will be considered late and are non-refundable.
-
Failure to attend a booked session without notice (no-show) will result in the loss of that session or charge in full.
6. Rescheduling Policy
-
Clients may reschedule sessions up to 12 hours before the scheduled start time.
-
Rescheduling within 12 hours of the session start time is not permitted.
-
All rescheduling must be completed through the official booking platform or by contacting the Gym.
7. Arrival & Attendance
-
Clients are encouraged to arrive at least 5–10 minutes early to allow for check-in and warm-up.
-
Late arrivals may be refused entry for safety reasons and will be treated as a no-show.
8. Health & Safety
-
Clients must inform instructors of any injuries, medical conditions, or limitations prior to participating.

Clients are responsible for ensuring they are medically and physically fit to take part in sessions.
-
The Gym reserves the right to refuse participation if a client appears unwell or poses a risk to themselves or others.
9. Code of Conduct
-
All clients must behave respectfully towards staff, instructors, and other members.
-
Harassment, disruptive behaviour, or misuse of equipment will not be tolerated.

The Gym reserves the right to remove or suspend any client who breaches this policy.
10. Liability & Assumption of Risk
-
Participation in gym sessions is undertaken at the client’s own risk.
-
The Gym and its staff are not liable for injury, loss, or damage sustained during sessions, except where caused by proven negligence.
11. Changes by the Gym
-
The Gym may cancel, amend, or reschedule sessions, class times, instructors, or services due to operational requirements.
-
Where possible, clients will be offered an alternative session or appropriate credit.
12. Pricing & Service Changes
-
The Gym reserves the right to review and amend pricing or services with reasonable notice.
-
Any changes will not affect a member’s minimum commitment period.
13. Privacy & Data Protection
-
Personal data is processed in accordance with the Gym’s Privacy Policy.
-
Data is handled in compliance with UK GDPR and the Data Protection Act 2018.
-
Personal information will not be shared with third parties without consent, unless legally required.
14. Cooling-Off Period
-
Where applicable, clients have a statutory 14-day cooling-off period under the Consumer Contracts Regulations 2013.

By booking a session scheduled to take place within 14 days, the client expressly agrees to waive this right.
15. Force Majeure
-
The Gym shall not be liable for any failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, government restrictions, or staff illness.
16. Governing Law
-
These Terms and Conditions are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the English courts.
17. Changes to These Terms
-
The Gym reserves the right to update these Terms and Conditions with reasonable notice.
-
Clients will be informed of significant changes via email or the official booking platform.
These Terms and Conditions apply solely to services provided directly by MWH Elite Performance Centre and do not apply to third-party personal trainers or external commercial hires.
