Terms & Conditions

These Terms and Conditions apply to all clients booking or attending sessions, purchasing class packs, or holding memberships at MWH Elite Performance Centre (“the Gym”).

These Terms apply to all classes, memberships, class packs, and specialist programmes including Baby Gains and Women’s Only sessions.

By booking a session, purchasing a membership or package, or attending a class, you agree to be bound by these Terms and Conditions.

1. Booking Policy

  • All bookings must be made via the Gym’s official booking system (LegitFit).

  • A session place is only confirmed once the booking has been completed and payment (where applicable) has been successfully processed.

  • Class spaces are limited and allocated on a first-come, first-served basis.

  • Membership holders must still book classes in advance and are subject to class capacity limits.

  • Access to bookings may be restricted where payment has failed, is overdue, or a membership is inactive.

2. Payment Terms

  • Full payment is required at the time of booking unless the client holds a valid class pack or active membership.

  • Membership fees are charged monthly in advance via automatic recurring payment.

  • The Gym reserves the right to suspend booking access where payment is overdue, failed, or incomplete.

  • All fees are non-transferable and non-refundable, except where required by law.

3. Membership Terms 

3.1 Membership Type

All memberships are class-based unless otherwise stated.
Memberships do not include open gym access or independent training.

3.2 Automatic Payments

By purchasing a membership, you authorise the Gym to collect recurring monthly payments via your chosen payment method.

It is the client’s responsibility to ensure payment details remain up to date.

3.3 Minimum Commitment

All memberships are subject to a minimum commitment period of two (2) months from the start date.

Memberships cannot be cancelled within this period unless agreed at the Gym’s discretion in exceptional circumstances (e.g. medical reasons with evidence).

3.4 Cancellation After Minimum Term

After the minimum term, memberships may be cancelled with 30 days’ written notice.

Cancellation requests must be submitted via email or through the LegitFit platform.

Memberships remain active and chargeable during the notice period.

No refunds are given for unused time.

3.5 Failed Payments

If a payment fails, the Gym may:

  • Suspend booking access

  • Reattempt payment

  • Cancel membership if payment remains outstanding

Repeated failed payments may result in termination of membership.

3.6 Membership Use

Memberships are personal, non-transferable, and must only be used by the named individual.

Misuse may result in suspension or cancellation without refund.

4. Class Packs & Pay-As-You-Go Sessions

  • Class packs and single sessions are valid only for the number of sessions purchased.

  • They are non-transferable and non-refundable.

  • Where applicable, class packs may be limited to specific class types.

  • Drop-in sessions are available for selected classes, with pricing shown at the time of booking via LegitFit.

  • Unused sessions may expire depending on the validity period stated at purchase.

5. Cancellation & No-Show Policy

  • Sessions must be cancelled or rescheduled at least 12 hours before the scheduled start time.

  • Cancellations made within 12 hours of the session will be considered late and are non-refundable.

  • Failure to attend a booked session without notice (no-show) will result in the loss of that session or charge in full.

6. Rescheduling Policy

  • Sessions may be rescheduled up to 12 hours before the scheduled start time.

  • Rescheduling within 12 hours is not permitted.

  • All changes must be made via LegitFit.

7. Arrival & Attendance

  • Clients should arrive 5–10 minutes before the start of their session.

  • Late arrivals may be refused entry for safety reasons and treated as a no-show.

8. Health & Safety

  • Clients must inform instructors of any injuries, medical conditions, or limitations before participating.

  • Clients are responsible for ensuring they are medically fit to take part in exercise.

  • The Gym reserves the right to refuse participation if a client may be at risk.

9. Code of Conduct

  • All clients must behave respectfully towards staff, coaches, and other members.

  • Disruptive behaviour, harassment, or misuse of equipment will not be tolerated.

  • The Gym reserves the right to suspend or remove any client who breaches this policy.

10. Liability & Assumption of Risk

  • Participation is undertaken at the client’s own risk.

  • The Gym and its staff are not liable for injury, loss, or damage except where caused by proven negligence.

  • This includes injuries arising from misuse of equipment or failure to follow instructions.

11. Baby Gains Class – Children & Supervision

  • Baby Gains is a postnatal fitness class where babies and young children are permitted within the training space.

  • By attending this class, clients acknowledge that:

  • Children remain the sole responsibility of the parent or guardian at all times

  • The Gym and its staff are not responsible for supervising children

  • Parents/guardians must ensure children remain safe and do not pose a risk to themselves, others, or equipment

  • The training environment includes gym equipment and movement spaces

  • The Gym accepts no liability for injury, loss, or damage caused by a child’s actions, except where required by law

  • The Gym reserves the right to refuse entry or request a participant leaves if a child’s behaviour is unsafe or disruptive.

12. Classes & Services

  • The Gym offers Functional Fitness, Strength Training, Women’s Only sessions, Baby Gains (postnatal), and Personal Training services.

  • Class availability may vary depending on timetable and demand.

13. Changes to Services

  • The Gym may amend, cancel, or reschedule sessions, class times, or instructors where required.

  • Where possible, clients will be offered an alternative session or credit.

14. Pricing & Service Changes

  • The Gym reserves the right to update pricing and services with reasonable notice.

  • Changes will not affect any active minimum membership term.

15. Privacy & Data Protection

  • Personal data is processed in accordance with our Privacy Policy and UK GDPR regulations.

  • Data is only shared where legally required or necessary for service delivery.

16. Cooling-Off Period

  • Where applicable, clients have a 14-day cooling-off period under the Consumer Contracts Regulations 2013.

  • By booking a session scheduled within this period, you agree to waive this right.

17. Force Majeure

  • The Gym is not liable for failure or delay caused by events outside its control, including but not limited to extreme weather, pandemics, government restrictions, or staff illness.

18. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes will be subject to the exclusive jurisdiction of the English courts.

19. Changes to These Terms

The Gym may update these Terms and Conditions at any time.

Significant changes will be communicated via email or the LegitFit platform.

20. Third Party Training

These Terms apply only to services provided directly by MWH Elite Performance Centre and do not apply to independent or third-party trainers operating from the facility.
